Biden Declares ‘Equal Rights Amendment’ Ratified, Setting Up Legal Battle

President Joe Biden and Vice President Kamala Harris celebrated the supposed

ratification of the Equal Rights Amendment (ERA) as the “28th Amendment” to the Constitution,

despite constitutional experts stating it has not been legally ratified. The president also

lacks authority to unilaterally declare an amendment ratifie, Biden claimed Virginia’s 2020

ratification made the ERA official, citing support from the American Bar Association and some

legal scholars. However, constitutional rules require Congress to validate amendments, and

legal challenges remain. Biden emphasized his long-standing support for the ERA and called

it overdue recognition of women’s equality, though its official status remains contested
